FAILURE TO YIELD RIGHT OF WAY
Sharing the roadway with other vehicles or giving space to others is
known as the right of way. Failure to yield right of way is the second
most common driver error and prominent contributor to vehicle crashes.
Right of passageway violations is reported as a factor of all
accidents. Any time you encounter another vehicle, one f you must yield
the right of way. Failure to yield right of way does not only make you
an aggressive driver but also a law breaker.
A driver who yields the right of course usually avoids any possible
conflict with another vehicle. When you let an aggressive driver
through you’ll prevent the frustration and negative emotions that can
activate road rage.
Drivers often rationalize these errors by claiming they had the right
of way. This is a common misconception. The truth is no one has the
right of way. Traffic regulations only state who must yield the right
of direction.
A driver of a vehicle approaching an intersection shall yield the right
of way to a vehicle which has entered the intersection. When two
vehicles enter an intersection at the same time the driver of the
vehicle on the left shall yield the right of way to the driver of the
vehicle on the right.
Drivers must also yield to other drivers at any intersection where
there is a stop sign, at a four-way stop intersection, when making a
left turn at an intersection, highway, passage or private road and if
the police or authorized emergency vehicles are using sirens, lights or
both.
As a professional driver, yielding the right of way is much more than
obeying the guidelines. It is being courteous to other motorists and
building a positive public image.
A driver is guilty of failure to yield right of way if he fails to give
way to a pedestrian in a marked crosswalk. It is also an offense to
fail to give the right of lane to any pedestrian caught in a marked or
unmarked crosswalk when the signal changes.
A driver convicted of failure to yield right of way may be subject to a fine
and will be assessed two points for his violation.
If you have been injured in a car accident as a result of the driver’s
failure to yield right of way it is best to contact a lawyer
immediately to protect your rights and ensure that you receive just
compensation for your injuries.
